1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", or "Partner") and NIVARA ONE TECHNOLOGIES PRIVATE LIMITED ("Company", "Nivara One", "we", "us"). By accessing or using our websites (https://nivaraone.in), mobile applications (Nivara One, Nivara Go, Nivara Hub), or booking scrap pickups, you agree to be bound by these Terms.
2. Nivara One: Doorstep Scrap Collection Services
- Digital Scale Weighing: All scrap items offered by the customer are weighed exclusively on certified digital hanging/flat scales carried by verified Nivara Go partners. Manual estimation is strictly prohibited.
- Daily Spot Rate Integrity: Payout amounts are computed strictly in accordance with published spot rates at the time of order confirmation. Rates are updated transparently on a daily basis.
- Handshake PIN Protocol: Upon completion of doorstep weighing and handing over of the calculated cash payout (or execution of instant UPI payout), the collector provides a unique 4-digit PIN. The customer inputs this PIN in Nivara One to certify cash receipt and complete the transaction.
- Zero Deduction Guarantee: Households receive 100% of the calculated scrap value with zero service fees, pickup charges, or hidden deductions.
3. Prohibited Materials & Hazardous Waste
Customers agree NOT to tender any of the following restricted or prohibited materials for collection:
- Bio-medical waste, used syringes, or clinical refuse.
- Hazardous chemical containers, radioactive materials, or toxic industrial by-products.
- Explosive devices, ammunition, or pressurized hazardous gas cylinders.
- Stolen property or items obtained through unlawful means. Our partners reserve the absolute right to refuse collection and report unlawful materials to local law enforcement authorities.
4. Upcycled Creators Studio (Marketplace Terms)
- Product Authenticity: All goods showcased in the Creators Studio are handcrafted by verified artisans using recycled, reclaimed, and secondary materials. Minor variations in texture, color, and finish are characteristic of circular handmade products.
- Pricing & Payments: All prices listed are inclusive of applicable GST. Payments are processed securely via RBI-compliant electronic payment gateways.
- Fulfillment & Shipping: Standard delivery timelines within Delhi NCR range between 2 to 4 business days. Pan-India shipping is completed within 4 to 7 business days.
5. Nivara Go: Logistics Partner Fleet Terms
- Independent Partner Status: Nivara Go collectors operate as verified independent logistics partners using the platform to receive optimized daily collection routes and dispatch alerts.
- Platform Service Fee (8% Platform Cut): A flat 8% white-money platform facilitation cut is automatically debited from the collector's operating wallet upon successful 4-digit PIN verification handshake for each completed household pickup.
- Certified Facility Delivery: Partners are mandated to deposit sorted scrap volumes exclusively at CPCB/DPCC-registered Nivara Hub facilities to guarantee 100% landfill diversion and auditable recycling.
6. Intellectual Property
All trademarks, software architecture, user interfaces, branding ("Nivara One", "Nivara Go", "Nivara Hub"), logos, and domain names are the exclusive intellectual property of NIVARA ONE TECHNOLOGIES PRIVATE LIMITED. Unauthorized reproduction, reverse-engineering, or scraping is strictly prohibited.
7. Limitation of Liability
To the maximum extent permitted by Indian law, Nivara One Technologies Private Limited shall not be liable for any indirect, incidental, or consequential damages arising from service delays caused by force majeure events, severe weather conditions, or local governmental restrictions.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Delhi, India.
